What is a psychosocial evaluation?
A psychosocial evaluation is a professional report that documents an adult’s incapacity and their need for protection or representation. The court requires it to homologate a protection mandate (formerly called a mandate in case of incapacity) or to institute tutorship for an adult. Since November 1, 2022, curatorship no longer exists: adult tutorship and the protection mandate are the measures in place.
In this context, the psychosocial evaluation is a reserved act of social workers. At Clinique Octobre, it is carried out by a social worker in good standing with the OTSTCFQ, following the forms and requirements of Quebec’s Curateur public.
Timelines: the deciding factor. In the public network, obtaining a report can take up to a year and a half according to JuridiQC. Privately, that delay shrinks dramatically: our team can see you quickly, in Laval or remotely.
When is it required?
Homologation of a protection mandate
Your loved one prepared a mandate and can no longer care for themselves or their property. The court requires a medical report and a psychosocial report to make the mandate enforceable.
Institution of adult tutorship
No mandate was prepared: tutorship allows the appointment of a legal representative. The evaluation establishes the need for protection and the degree of incapacity.
Temporary representation
To carry out a specific act on behalf of an incapacitated person (selling a house, settling an estate) without instituting a full protective measure.
Common situations: Alzheimer’s disease and other neurocognitive disorders, stroke, traumatic brain injury, intellectual disability, severe mental health disorders.

Who can perform a psychosocial evaluation in Quebec?

Does curatorship still exist?
No. Curatorship for adults was abolished on November 1, 2022. People who were under curatorship automatically came under adult tutorship. The current measures are adult tutorship, the protection mandate, temporary representation and assistance for adults.
Is a medical evaluation also required?
Yes. The court requires a medical evaluation report from a physician in addition to the psychosocial report. Both documents accompany the application.
How long does the evaluation take?
